At James Avery, we value our customers' privacy and want you to be familiar with how we may collect, use and disclose your information while operating our business and interacting with you. Information We May Collect About You

We also collect data that you personally enter into our website, and data that you provide to our sales associates in James Avery retail stores or our Customer Service associates. We may collect this information in connection with inquiries, purchases, promotions, catalog orders, email correspondence, and online registrations. We may also receive information about you generated as a result of our other interactions with you, information from third parties (such as social media services, joint marketing or analytics partners) or public databases, and information that you directly provide to us through any phone, mail, fax, email, chat or other online interactions, sweepstakes or registrations that you submit. The information may include personal identifiers, such as your name, profile name, or social media username; mailing address; email address; phone number; IP address; any personal preferences you choose to provide; transaction details such as style, size, price, date, store; general demographic data, such as age, marital status, or gender; and inferences drawn from any of the above. Information may also be collected when you interact with us on social media, such as when you “like” us or when you use one of our hashtags.
We may collect your audio and visual information, including photographs, images, videos (such as security cameras and CCTV recordings in/about our Retail Stores) for safety, security, fraud, loss prevention, and operational purposes, and recordings of your voice (such as when we record customer service calls for quality assurance).
We use a third-party payment processor to handle all customer payment transactions. When you make a payment at checkout, any sensitive payment information you provide, such as your credit card number, will be collected and used only by the payment processor for purposes of completing the transaction.
How We Use Information and How You Can Control Such Use
The information we collect is used to process orders, to bill and collect payment, to resolve problems or customer inquiries, to contact customers or prospective customers, to learn about our customers and personalize content, to meet legal concerns or obligations, and to maintain or improve our products and services, including our email or other marketing outreach, our website, and any other of our online or other business activities.
If you supply us with your mailing address, you may receive mailings from us with information on new products and services or upcoming events. If you do not wish to receive such mailings, you may utilize the applicable Opt-Out Method listed at the bottom of this Privacy Notice.
Within our website you have the option to join our email list and receive emails containing promotional information about our products, services, and offers. In addition, if you provide us with your email address on any of our other online pages or to our customer service or in-store associates, you may automatically be added to our email list and receive such emails. If you do not wish to receive our promotional emails, you may opt-out by clicking on the “unsubscribe” link found at the bottom of all such emails or by contacting us using any of the Contact/Opt-Out Methods listed below.
Except as provided in our SMS terms below, if you supply us with your phone number, you will only receive telephone contact from us concerning any issues with your order or in response to your direct inquiries or instructions. The information that you give us and information about your James Avery orders may be combined with other personally identifiable information (such as demographic and past purchase history) available from our records and those of our marketing partners and public sources. This information will be used to make our future marketing efforts more efficient. Except as otherwise stated to the contrary herein, such information may also be shared with other reputable marketers to bring you offers of interest.
We may share data that has been aggregated or deidentified such that under applicable laws it is no longer considered personal information. When we share aggregated or deidentified data, we require recipients to refrain from reidentifying the data.
We may provide personally identifiable or other information, without notice to you, in response to a lawful request from a law enforcement or government agency or in response to a formal request in a civil action that on its face meets the requirements for such a request. In addition, we may provide personally identifiable information, without notice, to credit bureaus or collection agencies if we are permitted or required to do so by law.
Optional Text Message (SMS) Communications
We offer you the option to receive order status updates and/or promotional alerts by text message from James Avery (collectively, our “SMS service”), subject to the below terms and this Privacy Notice.
- James Avery Order Alerts (short code: 26987). To receive status alerts about your order, you may opt in during checkout at JamesAvery.com. You will receive up to 4 messages per order.
- James Avery Promotional Alerts (short code: 94218). To receive James Avery promotional alerts (new arrivals, style inspiration, abandoned cart alerts and more), you may opt in during checkout at JamesAvery.com or by completing any other opt-in forms offered during your interaction with us. Message frequency varies.
- Consent is not a condition of any purchase. Message and data rates may apply. You may cancel Order Alerts or Promotional Alerts at any time by replying "STOP” to the applicable short code. We will send you a final SMS message to confirm that you have been unsubscribed from the applicable program. If you want to join again, just sign up as you did before. We reserve the right to change the SMS service short code(s) and we will notify you if we do so.
- If you experience any issues with the SMS service, reply with “HELP” for more assistance, or you can contact James Avery Customer Service directly at customer.service@jamesavery.com or 1-800-283-1770. If you have any questions about your text or data plan, please contact your wireless provider. Carriers are not liable for delayed or undelivered messages. Not all mobile devices may be supported, and our messages may not be deliverable in all areas or to all mobile carriers.
- Unless you expressly opt into promotional alerts as provided above, the phone number you provide will not be used for promotional purposes, nor will it be shared with any third party other than our service provider solely for purposes of providing the SMS service.
Use of Cookies and Similar Tools
Cookies, pixels and similar automated tools are delivered and received by our website (or, in some instances, by our emails or online ads) and stored by your browser on your device. We and our third-party service providers may use such tools to learn about visitors' preferences and internet session information, to record user-specific information, including IP addresses, browser information, and browsing activities, and to detect and prevent fraud. Such tools also allow us to tailor offerings to website visitor preferences, provide better service to return visitors, and optimize our marketing efforts. You will need to adjust the settings on each browser and on each device for which you wish to block cookies. Please note that disabling, blocking or deleting cookies in your browser settings may prevent you from enjoying the full features offered at our website. State Consumer Privacy Rights

You may exercise any of those rights directly through our Privacy Center or by calling Customer Service at the number below for assistance. Only you, or your authorized agent or guardian (with sufficient verifiable proof), may submit a request related to your personal information. Recognizing the risk of potential abuse of these requests as an identity theft tool, we will send you a verification email to confirm your identity. If you do not timely respond as instructed in such email, you will need to resubmit your request. If necessary to better protect your privacy, we may ask for certain verifiable information to match against our records or ask for an alternative form of contact. You may be able to appeal any denial of your request regarding your Personal Information. To do so, please complete the appeal form provided with your original request or contact Customer Service at the number below.
Opt Out of Sale/Share and Targeted Advertising. While we are not data brokers and we do not sell any personal information in exchange for monetary consideration, you may opt out of our sharing your personal information for targeted advertising efforts (whether cookie or non-cookie based), which some state laws consider “selling” your personal information.
- You can opt out of cookies for targeted/behavioral advertising by visiting our Privacy Center and selecting the “Purposes” tab. Our website is capable of recognizing your individual browser settings that limit or prevent information sharing via cookies located on our website. Remember that you will need to adjust the settings on each browser and on each device for which you wish to block cookies. We will treat Global Privacy Control (GPC) browser signals as opt-out of cookie-based sale/targeted advertising requests.

Live Chat
We use a live webchat service provided and facilitated by our third-party provider, SalesForce. James Avery Customer Service associates chat directly with our customers; we do not utilize chatbot service features. SalesForce collects, uses, stores, shares, discloses, places cookies, and protects customer information in accordance with its privacy policy: Privacy Policy - Salesforce.com. The data this provider stores from our customers is strictly for our use. Information can include operator names and emails, visitor names and emails, visitor phone numbers, email addresses, and IP addresses.
Protection/Security
We employ reasonable, industry-standard and appropriate security measures to protect personally identifiable information in our possession, and we require the same of our third-party service providers. While such measures include encryption, tokenization and other obfuscation methods, principles of “least required access” and “validated business need” for access, and technical authentication measures to protect against the loss, misuse, or alteration of information, no information transmissions on the internet are completely secure. Consequently, while we strive to secure your personal information, we cannot guarantee such security, and, to the fullest extent allowable by law, you ultimately provide such information at your own risk. We encourage you to take certain steps to protect your online accounts (such as your JamesAvery.com account) and your personal data, for example by not sharing passwords or reusing passwords across multiple websites, choosing passwords that are not easily guessed, and promptly reporting any suspicious activity or unauthorized account access.
Protecting Children
Our website is not intended for children under the age of 16 and we do not knowingly permit such children to purchase products on our website or otherwise interact with us through our services without parental consent. We encourage parents to supervise and participate in their children's internet activities, and we urge children to exercise caution and consult their parents before visiting any website or providing any personal information on the internet.
