What Information We Collect

We may also receive other information about you generated as a result of our interactions with you, information from third parties (such as social media services or joint marketing partners) and information that you may directly provide to us through any phone, mail, fax, email, online interactions, sweepstakes or any paper registrations that you submit. The information that may be collected includes personal identifiers, such as your name, profile name, or social media user name; mailing address; email address; phone number; IP address; any personal preferences you choose to provide; transaction details such as style, size, price, date, store; and inferences drawn from any of the above. Information may also be collected when you interact with us on social media, such as when you “like” us or when you use one of our hashtags.

We use a third-party payment processor to handle all customer payment transactions. When you make a payment at checkout, any sensitive payment information you provide, such as your credit card number, will be collected and used only by the payment processor for purposes of completing the transaction.

How We Use Information and How You Can Control Such Use

The information we collect is used to process orders, to bill and collect payment, to resolve problems or customer inquiries, to contact customers or prospective customers, to learn about our customers and personalize content, to meet legal concerns or obligations, and to maintain or improve our products and services, including our email or other marketing outreach, our website, and any other of our online or other business activities.

If you supply us with your mailing address, you may receive mailings from us with information on new products and services or upcoming events. Persons who supply us with their telephone numbers will only receive telephone contact from us concerning purchases or direct inquiries made by such persons.

The information that you give us and information about your order may be combined with other personally identifiable information (such as demographic and past purchase history) available from our records and other sources. This information will be used to make our future marketing efforts more efficient. This information may also be shared with other reputable marketers to bring you offers of interest. If you prefer that we do not share your information with other reputable marketers, please contact us at any of the Contact/Opt-Out Methods listed below and request that your name be marked as “do not share”. Further, upon your request via any of those methods, we will happily correct any inaccurate information concerning you that we may have in reasonably obtainable form.

California Consumer Privacy Rights

In addition to generally disclosing what personal information we collect, how we use or share such information, and your options related to such use as provided above, the California Consumer Privacy Act (CCPA) requires that we notify California residents of certain rights they have related to personal information. Subject to such law, California residents have the right to:

  • Submit a verifiable request to us (no more than twice in a 12-month period) to disclose what personal information about you we have collected, used, disclosed, or sold in the 12 months preceding such request (“Information Request”);
  • Request the deletion of your personal information that we have collected (“Deletion Request”), subject to various exceptions under the CCPA, including, but not limited to, using such information internally in a lawful manner that is compatible with the context in which you provided the information or to provide a good or service reasonably anticipated in our ongoing business relationship with you.
  • Correct any inaccurate personal information we may have about you (“Correction Request”); and
  • Opt-out of our sharing/“selling” your personal information to third-parties (“Do-Not-Share/Sell Request”), including for targeted advertising as described above.

Exercising Your California Rights. The Information, Deletion, and Correction Requests mentioned above may be submitted via any “Contact Method” provided below. Only you, or your authorized agent or guardian (with sufficient verifiable proof), may submit a request related to your personal information. The submission must describe the specific request with sufficient detail that allows us to properly understand, evaluate, and respond to it. Recognizing the risk of potential abuse of these requests as an identity theft tool, we may ask for certain verifiable information to match against any of your information we may already have access to. California - Do Not Share/Sell My Personal Information. While we are not data brokers and we do not sell any personal information in exchange for monetary consideration, California law requires that we provide options for California residents to opt-out of the use and sharing of their personal information for our targeted advertising efforts.

  • To opt out of the sharing of your device or browser information for interest-based advertising on websites that are unaffiliated with James Avery, please utilize the cookie opt-out options described in the Targeted Advertising section above.
  • Our website is cable of recognizing your individual browser settings that limit or prevent information collecting/sharing via cookies located on our website, including for targeted advertising purposes. However, our website may not recognize other user-generated privacy controls. Live Chat

We utilize a live webchat service provided and facilitated by our third party provider, SalesForce. SalesForce collects, uses, stores, shares, discloses, places cookies, and protects customer information in accordance with its privacy policy: Privacy Policy - Salesforce.com. The data this provider stores from our customers is strictly for our use. Information can include operator names and emails, visitor names and emails, visitor phone numbers, email addresses, and IP addresses.

Optional Order Updates via Text Message

During checkout at JamesAvery.com, you have the option to receive order status updates by text message from James Avery (our “SMS service”). You will receive up to 4 messages per order. You can cancel the SMS service at any time by replying "STOP” and we will send you a final SMS message to confirm that you have been unsubscribed. If you want to join again, just sign up as you did before during your next checkout.

Notwithstanding the other terms of this Privacy Notice, the phone number you provide will not be used for promotional purposes or shared with any third party other than our SMS service provider. We employ reasonable, industry-standard and appropriate security measures to protect sensitive information in our possession, including personally identifiable information, and we require the same of our third-party service providers as applicable. While such measures include encryption, tokenization and other obfuscation methods, principles of “least required access” and “validated business need” for access, and technical authentication measures to protect against the loss, misuse, or alteration of information that we collect from visitors on our website, no information transmissions on the Internet are completely secure. Consequently, while we strive to secure your personal information, we cannot guarantee such security, and, to the fullest extent allowable by law, you ultimately provide such information at your own risk.

Protecting Children

Our website is not intended for children under the age of 16 and we do not knowingly permit such children to purchase products on our website or otherwise interact with us through our services without parental consent.
